The websites www.alinamihai.com, alinamihai.mykajabi.com and members.alinamihai.com (together, the "Websites") and all content on them are owned and operated by Embody with Alina, the business of Alina Mihai ("we", "us" or "our"). By visiting or using the Websites, you agree to be bound by these Terms & Conditions. If you do not agree with them in their entirety, please refrain from using the Websites.

These Terms & Conditions are a legally binding agreement between you (whether personally or on behalf of an entity) and Embody with Alina concerning your access to and use of the Websites and any media, channels or applications connected to them.

Use of the Websites

You must be 18 years or older and have the legal capacity to enter into these Terms & Conditions. By using the Websites you represent that you are at least 18 years old. Use of the Websites by anyone under 18 is unauthorized.

We may update these Terms & Conditions at any time by posting the revised version on this page and updating the effective date above. Your continued use of the Websites after changes are posted constitutes acceptance of the revised terms.

If you purchase a program, product or service from us, that purchase is governed by the Terms of Use or Client Agreement associated with it, which prevails over these Terms & Conditions in the event of a conflict. Refunds, cancellations, rescheduling and program participation policies are set out in those agreements. Private coaching and mentoring packages require signature of a separate agreement.

Intellectual Property Rights

The Websites contain original work created and owned by Embody with Alina and protected under United States intellectual property law. This includes, without limitation, website design, layout, photographs, graphics, text, video, audio, documents, program names, our logo, artwork, color scheme and branding (together, the "Content").

You agree that you will not copy, edit, distribute, republish, sell or otherwise exploit any Content, hold any Content out as your own, share purchased materials with people who have not purchased them or use any portion of the Websites or Content for commercial gain, without our express written permission. Requests for permission may be sent to support@alinamihai.com. Unauthorized use may constitute infringement, and we reserve the right to revoke access to the Websites or any purchased program without refund and to pursue infringement to the full extent of the law.

Your Content

You may have the opportunity to post content to the Websites or our channels, including comments, testimonials and photos. By posting, you represent that you are the owner of what you post and are at least 18 years old.

You retain ownership of the content you post. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce and display that content in connection with the Websites and our services, with or without identifying you as the author. You understand that you are not entitled to payment for our use of content you choose to post. If you would like content you posted removed, contact us at support@alinamihai.com and we will make reasonable efforts to remove it from the surfaces we control.

Testimonials

The Websites may feature testimonials from clients. All testimonials reflect the real, honest experience of actual clients and are not a guarantee that current or future clients will experience the same results. Individuals featured have their own histories and circumstances, and what worked for them may not work for you. Please use good judgment and consult your own professionals before beginning any program we offer.

Your Conduct

You may use the Websites for lawful purposes only. You agree not to post or transmit anything defamatory, harmful, harassing, infringing, fraudulent, obscene or otherwise objectionable; collect information about other users; interfere with the security or operation of the Websites; reverse engineer any software comprising the Websites; or use any automated system to access the Websites without permission.

We are the sole decider of whether posted content is objectionable and reserve the unilateral right to remove any content you post, without explanation. Should a third party take legal action against you as a result of something you posted on our Websites, you agree to hold us harmless and fully indemnify us.

Free Materials

Free downloads, printables and opt-in gifts are for your personal, non-commercial use only. They may not be copied, edited, distributed or shared other than in their original form with credit to us, and may not be used for any financial or other gain.

Disclaimer

The Websites exist solely to provide educational information. Nothing on the Websites or in our programs constitutes medical, psychological, legal, financial or other professional advice, and nothing offered here takes the place of consultation with a licensed professional regarding your specific situation. Please see our full Disclaimer page, which is incorporated into these Terms & Conditions. Your decision to use the Websites and any information on them is voluntary, and you agree to hold Embody with Alina harmless from any damages directly or indirectly resulting from that use.

Technology Disclaimer

We make no guarantees regarding the condition or availability of the Websites, including uninterrupted access or freedom from viruses or other harmful components. The Websites may be down for maintenance, repairs or other reasons at any time, and we may change or discontinue all or part of the Websites or their Content without notice. The Websites and all Content are offered on an "as is" basis without warranties of any kind.

Information You Provide

To join our email list or purchase products or services, you may be asked to provide information about yourself, including your name, email address, billing information and account credentials. You agree that all information you provide is accurate, current and belongs to you, and that you will not use anyone else's information as your own. You are responsible for keeping your username and password secure and for all purchases made through your account. Payment information collected during purchases may be processed by us and our payment processing company, and your purchase may also be subject to the processor's own terms and policies.

We reserve the right to refuse or cancel any order for any reason, including orders that appear fraudulent or placed by resellers or false accounts.

Limitations of Liability and Release

We take reasonable precautions to keep your information private, but we are not liable for unauthorized access to or use of your information or property regardless of the legal theory, even if such access was foreseeable. Our limitations of liability extend to the fullest extent permitted by law, and in no event shall our total liability exceed $500 to any one person or collective plaintiffs.

You agree that we are not liable to any party for any damages — direct, indirect, consequential, incidental or otherwise — stemming or perceived to stem from use of or reliance on any information found on the Websites or from products or services purchased through them, including any loss of income, clients, data or goodwill. Your decision to use the Websites is wholly at your own risk. You hereby release us from any and all claims, whether known now or discovered in the future, arising from your use of the Websites or reliance on their Content.

Indemnification

You agree to defend, fully indemnify and hold harmless Embody with Alina and its team members, agents and affiliates from any causes of action, damages, losses, costs or expenses incurred as a result of your use of the Websites, your breach of these Terms & Conditions or any third-party claim arising from your actions in relation to the Websites.

Termination

We reserve the right to refuse or terminate your access to the Websites at any time, for any reason, with or without notice. If you made purchases and we determine you are entitled to continued use of purchased information, we will make that information available to you in a reasonable way.

Dispute Resolution

These Terms & Conditions are governed by the laws of the State of California. Should any dispute arise, you agree to resolve any claim or controversy arising out of or relating to these Terms & Conditions by arbitration or a suitable alternative dispute resolution process in Oakland, California, regardless of your location, and to participate in good faith in that process. If an arbitrator determines any portion of these Terms & Conditions is invalid or unenforceable, the remaining portions shall remain valid and unaffected.

These Terms & Conditions, together with the Privacy Policy, the Disclaimer and any separate program agreements, constitute the entire agreement between us with respect to your use of the Websites.
